Please read these Terms of Service ("Terms") carefully before purchasing or using FamilyCodex software ("Software") from familycodex.org ("we", "us", "our").
1. License Grant
1.1 Free Version
The free version of FamilyCodex is provided under a limited license for personal, non-commercial use. You may install and use it on one domain.
1.2 Paid Versions (Family Pack, Family Pack Pro)
Upon purchase, we grant you a perpetual, non-exclusive, non-transferable license to:
- Install the Software on up to 2 domains (e.g., production and staging)
- Use the Software for personal or commercial purposes
- Receive lifetime updates to the major version purchased
- Access customer support according to your plan tier
2. License Restrictions
You may NOT:
- Redistribute, resell, sublicense, or share the Software or your license key
- Remove or alter any proprietary notices, labels, or marks
- Use the Software to create a competing product or service
- Reverse engineer, decompile, or disassemble the Software
- Use the Software in any way that violates applicable laws
- Share your license key publicly or with unauthorized parties
3. Payments and Pricing
3.1 One-Time Purchase
FamilyCodex is sold as a one-time purchase. There are no recurring subscription fees. The price displayed at checkout is the full price.
3.2 Payment Processing
Payments are processed securely by Stripe. By making a purchase, you agree to Stripe's terms of service. We accept major credit cards.
3.3 Pricing Changes
We reserve the right to change prices at any time. Price changes do not affect existing purchases.
4. Refund Policy
We offer a 30-day money-back guarantee on all paid purchases. If you're not satisfied with FamilyCodex for any reason, contact us within 30 days of purchase for a full refund.
To request a refund, email us at support@familycodex.org with your order number or the email address used for purchase.
5. Updates and Support
5.1 Software Updates
Your license includes lifetime access to updates within the major version (e.g., all 1.x versions). Major version upgrades may be offered at a discounted rate to existing customers.
5.2 Support
Support is provided according to your license tier:
- Free: Community support (forums, documentation)
- Family Pack: Email support (48-72 hour response)
- Family Pack Pro: Priority email support (24 hour response)
6. Your Data
FamilyCodex is self-hosted software. Your family tree data is stored on your own server, not on ours. You are responsible for:
- Backing up your data regularly
- Securing your server and installation
- Complying with privacy laws regarding data you collect
- Ensuring you have the right to store information about individuals in your tree
7. Third-Party Services
FamilyCodex may integrate with third-party services (OpenAI for AI features, OpenStreetMap for location data). Your use of these services is subject to their respective terms. We are not responsible for the availability, accuracy, or policies of third-party services.
8. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SOFTWARE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE.
10. License Termination
Your license is perpetual unless terminated. We may terminate your license if you:
- Violate these Terms of Service
- Share or distribute your license key
- Use the Software for illegal purposes
- Attempt to circumvent license validation
Upon termination, you must cease using the Software and destroy all copies.
11. Modifications to Terms
We may update these Terms from time to time. We will notify customers of material changes by email. Your continued use of the Software after changes constitutes acceptance. If you disagree with changes, you may continue using the version you have under the original terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where FamilyCodex operates, without regard to conflict of law principles.
